PER CURIAM.

The State of Alabama charged Charles William Cannon with the murder of the manager of a Birmingham service station on the night of May 31, 1972. Trial was held in the Tenth Judicial Circuit in Birmingham in 1973, and the jury convicted petitioner of second degree murder. The conviction was subsequently affirmed by the Court of Criminal Appeals in 1974. Petitioner then sought relief in the United States District Court for the Northern Division of Alabama...
