On May 30, 1978, the Citizens & Southern Bank (C & S) obtained a judgment against Gordon Malloy, an independent manufacturer's sales representative for Gant. On June 15, 1978, C & S filed a summons of garnishment against Malloy, naming Gant as garnishee. Gant answered the summons, stating that it owed no money to Malloy and held no sums which were subject to garnishment. C & S filed a traverse to Gant's answer, "saying the same is untrue...
