The defendant was convicted by a jury of six in the Third District Court of Eastern Middlesex on a complaint dated January 20, 1976, brought by the Department of Public Welfare (department) charging him and his wife with larceny from the Commonwealth (G.L.c. 266, § 30) from January 1, 1975, to August 28, 1975. The defendant's wife pleaded guilty before trial and the defendant was tried alone. The case is here on the defendant's bill of exceptions...
