COCHRAN, Justice.

Tried by the court, sitting without a jury, on an indictment charging statutory burglary, James Gilmore Sadoski was found guilty as charged. The court sentenced him to serve three years in the State penitentiary, but suspended execution of the sentence on condition that Sadoski spend 60 days in jail, and placed him on probation for a period of three years.

At trial, Sadoski took the stand in his own defense and testified on direct examination...
