The defendant, Nathaniel Brown, Jr., was charged with burglary of the Happy Day Nursery in Waukegan, Illinois, in violation of section 19-1 of the Criminal Code of 1961 (Ill. Rev. Stat. 1975, ch. 38, par. 19-1). The offense occurred about 2 a.m. on February 4, 1976. He was found guilty by a Lake County jury and was sentenced to three to nine years imprisonment.
