The appellant, Lawrence Clyde Price, was convicted in 1978 of the sale of heroin. Since the state tried appellant on the theory of aiding and abetting, the conviction was reversed on appeal because of improper jury instructions on the issue of intent. From this ruling the state does not petition for review and we concur with that portion of the Court of Appeals opinion.
