The plaintiff, David J. Tierney, Jr., Inc. (Tierney), commenced this action in the Superior Court to recover damages resulting from the defendant's (T. Wellington) alleged failure to perform under a contract for the installation of carpeting. The case was tried before a judge and jury and a verdict was returned in Tierney's favor in the amount of $12,131 plus interest. T.
