This case involves an appeal from a jury's verdict that James D. Martin (appellant) was guilty of the offense of driving while under the influence of intoxicating liquor, contrary to Topeka City Ordinance 26-1034. The verdict, given in district court, followed an earlier proceeding in the Topeka Municipal Court in which appellant was also found guilty of driving while under the influence of intoxicating liquor.
