On January 16, 1978, Robert James Kwallek was convicted of aggravated assault and battery pursuant to a charge that, on the 20th day of October, 1977, and contrary to § 6-4-506(a), W.S. 1977, he did

"unlawfully and maliciously inflict upon another person grevious [sic] bodily harm, in that he did strike one, John Weedman, about the face and body with his hands and feet causing grevious [sic] injury to the said John Weedman, a human being...
