Appellants, Marion and Edith Thomas, invoked diversity jurisdiction and brought separate claims of negligence against appellee Illinois Central. The claims were consolidated, the parties went to trial and at the close of the evidence, the district judge granted a directed verdict in favor of the railroad company.
