BRETT, Judge:

Appellant, Kenneth Eugene Dick, hereinafter referred to as defendant, was charged, tried to a jury, and convicted in the District Court, Cleveland County, Case No. CRF-75-650, of the offense of Unauthorized Use of a Vehicle, in violation of 47 O.S. 1971, § 4-102. Punishment was fixed at four (4) years in the State penitentiary and a fine of Four Thousand ($4,000.00) Dollars. From said judgment and sentence defendant has perfected...
