It arises from the denial by that judge of a motion by a person charged with murder for an order requiring the recordation of the testimony of all witnesses appearing before the grand jury and the denial by the trial judge of a further motion to allow that person to testify before the grand jury without his testimony being recorded, holding that if he testified before the grand...
