Cordell Kelly was indicted by the grand jury for the first degree murder of Brenda J. Joseph on May 13, 1978, in violation of La.R.S. 14:30. A mistrial was ordered when the jury was unable to agree on a verdict. After a second trial by jury on September 27, 1978, defendant was found guilty as charged.
