This is an appeal by the state of Ohio from an order of the Common Pleas Court of Wayne County dismissing with prejudice an indictment returned against the defendant.

The defendant, Ronald M. Sutton, was charged in Wayne County by affidavit on January 16, 1978, with extortion, R. C. 2905.11(A)(1) and (2). He waived preliminary hearing and was bound over to the grand jury. Defendant was subpoenaed...
