The plaintiff-appellant John G. McCue, hereinafter referred to as the appellant, filed a complaint against the defendant-appellee Buckeye Union Insurance Company, hereinafter referred to as the appellee, in the Common Pleas Court of Cuyahoga County on September 28, 1973.
