DORIS, Justice.

In 1974 the grand jury returned an indictment against the defendant, Robert L. Studman, charging him with assaulting a correctional officer while confined at the Adult Correctional Institutions (ACI). The defendant pleaded nolo contendere and on February 9, 1976, he was sentenced to two years in the ACI. Execution of the sentence was suspended and the defendant was placed on two years' probation.
