As will be more fully detailed below, the instant suit was originally filed asking this Court to declare unconstitutional a state statute and to enjoin the attempted enforcement of same. Shortly after this suit was filed, the State of Texas sued some of the federal plaintiffs in state district court seeking to enforce the precise state statute in question.
