The defendant, Daniel Joseph Smith, was convicted by a jury of kidnapping, Ind. Code § 35-1-55-1 (Burns 1975), and exercising unauthorized control over a vehicle, Ind. Code § 35-17-5-9 (Burns 1975). He is currently serving a life sentence on the first count and was assessed a minimum fine on the second count.
