This action is before the Court on plaintiff's post trial motion for a new trial. At the conclusion of an eight day trial, the jury returned a verdict finding: (1) negligence on the part of defendant (AMTRAK); (2) contributory negligence of 55% on the part of plaintiff (LEGETTE); and (3) total damages in the amount of $40,000.
