OPINION

DUNCAN, Judge.

The appellant-defendant, Ronald E. Ledune, along with four other individuals,1 was indicted for first degree murder. He was tried separately in the Henderson County Circuit Court, found guilty of first degree murder and sentenced to serve 28 years in the penitentiary. However, for reasons not stated in the record, the trial court granted the defendant's motion for a new trial2
