The appellant Barbara Schaffer, d/b/a Love Machine, whose business was closed as a public nuisance by the Municipal Court of Atlanta, timely applied for certiorari to the Superior Court of Fulton County. The writ issued, the magistrate was ordered to respond but failed to do so until after the city had moved to dismiss.
