WALTON v. SANDS

No. 77-2024.

374 So.2d 1109 (1979)

E. Ben WALTON, Jr., William P. Walton and E.B. Walton, Inc., Appellants, v. George H. SANDS, R.S. Black, et al., Appellees.

District Court of Appeal of Florida, Fourth District.

September 6, 1979.

Attorney(s) appearing for the Case

Larry Klein and Cone, Owen, Wagner, Nugent, Johnson & McKeown, P.A., West Palm Beach, for appellants.

Louisa Smith-Adam of Montgomery, Lytal, Reiter, Denney & Searcy, P.A., West Palm Beach, for appellee, Black.

PER CURIAM.

Appellant is one of two co-defendants who filed a cross-claim which was dismissed with prejudice by the court below. The dispute between the co-defendants/cross-claimants appears to be completely disposed of by the contract between them which provided they would share equally in any liabilities. We, therefore, conclude the trial court correctly dismissed the cross-claim with prejudice and said order is hereby AFFIRMED.

AFFIRMED.
