HUTCHINSON, Justice.

This is a suit for damages for malicious prosecution and for the conversion of personal property. Appellant, Germany, appeals from a summary judgment that he take nothing by reason of his suit against appellee, Love.

In November of 1969, appellee's place of business was burglarized and a number of blank checks were stolen. At the time of the burglary, Germany was an employee of Love working at the premises where the burglary occurred....
