Defendant Avery pleaded guilty to possession of unregistered firearms, namely sawed-off shotguns, in return for the dismissal of the other three counts and the Government's promise to remain mute at the time of sentencing. Following her being sentenced to four years' imprisonment she appealed claiming the plea agreement had been violated.
