The opinion of the Court delivered March 14, 1979, is withdrawn. The following is now the opinion of the Court.

This is a mandamus action brought by William Howard Stoner wherein Willa Hudgins has intervened. Hudgins obtained judgment against Stoner in the trial court and Stoner perfected an appeal to the Court of Civil Appeals, Second Supreme Judicial District. The Court of Civil Appeals wrote three opinions, the first dated May 25, 1978...
