MEMORANDUM

REGAN, District Judge.

At his third trial, petitioner, a recidivist, was convicted in the Circuit Court of the City of St. Louis of the crime of robbery in the first degree. On June 12, 1975, he was sentenced by the Court under the Second Offender Act of Missouri to a term of 55 years imprisonment. On appeal to the Missouri Court of Appeals, St. Louis District, the conviction was affirmed in a lengthy opinion written by Chief Judge Simeone.
