Appellant Naftalin was convicted in United States District Court for the District of Minnesota on eight counts of employing a scheme to defraud1 in the offer or sale of stock in violation of § 17(a)(1) of the Securities Act of 1933, 15 U.S.C. § 77q(a), and was sentenced to five years imprisonment on each of the eight counts, to be served concurrently.
