GIBSON, Chief Judge.

A jury found Russell Wayne Benfield guilty of misprision of a felony in violation of 18 U.S.C. § 41 and acquitted him of being an accessory after the fact to kidnapping in violation of 18 U.S.C. § 3.2 After being sentenced to prison for two years on the misprision charge, Benfield brings this appeal. We reverse and remand.
