This case was brought by the United States seeking injunctive relief against the owners of a marina on the Arkansas River at Little Rock, who were alleged to have constructed and maintained a breakwater dike in the navigable waters of the United States in violation of the Corps of Engineers permit, pursuant to 33 U.S.C. § 403, under which the construction of the dike was authorized.
