From his conviction of capital murder in the Circuit Court of Jackson County and the imposition of the sentence of death, Jimmy Lee Gray has appealed here. The indictment upon which Gray was tried charged him with the capital murder of one Deressa Jean Scales, in that the victim, a three-year old girl, had been kidnapped by Gray and killed by him in the course of the kidnapping.
