The Grand Jury of Orleans Parish returned an indictment on October 21, 1976 charging that on October 12, 1976 Danny Welch committed aggravated rape upon a named female. La.Rev.Stat. 14:42 (1975). After trial the jury returned a verdict of guilty of attempted aggravated rape, and the trial judge sentenced defendant to serve twenty-five years imprisonment at hard labor without benefit of probation or parole.
