This is an action for wrongful death resulting from a railroad crossing accident.

A pickup truck in which Bobby Joe Kennedy and Louis Chalk were riding was struck at a grade crossing by one of the trains of appellee, Southern Pacific Transportation Company, killing Kennedy and injuring Chalk.
