The appellants in this case instituted an action to enforce certain rights allegedly arising from 1) a preferential hiring agreement with the defendants-appellees (Count I) and 2) a consent decree entered into by the defendant-appellee, Local 520, International Union of Operating Engineers (Count II). In addition, the appellants sought damages and other affirmative relief under 42 U.S.C. § 1981 for alleged racially discriminatory practices...
