OPINION

Defendant Sindona makes the following motion with respect to the indictment:

(1) To dismiss the indictment on the basis of the 5-year limitation in 18 U.S.C. § 3282; (2) To dismiss Count 1—the conspiracy count—because it is duplicitous; (3) To dismiss the indictment for violation of Fed.R.Crim.P. 6(d), unless the Government makes a showing of nonviolation.
