This case was appealed to the Arkansas Supreme Court and by that court assigned to the Arkansas Court of Appeals pursuant to Arkansas Supreme Court Rule 29(3).

This appeal is from a conviction on the charge of theft of property under Ark.Stat. Ann. § 41-2203(2)(b). Defendant waived a jury and was sentenced to two years imprisonment.
