ROSS, Circuit Judge.

William Edward Brown appeals from his conviction for conspiracy to distribute, and to possess heroin with intent to distribute, in violation of 21 U.S.C. § 846. On appeal, he argues that the district court1 erred in denying his pretrial motion to dismiss, in admitting into evidence a taped telephone conversation, and in refusing his requested instructions to the jury. We affirm.
