On the morning of December 31, 1972, Gordie S. Mullens, a gasoline service station attendant at Daniels, West Virginia, was shot to death.

Over a year later, on January 17, 1974, the defendant, while an inmate at Leckie Correctional Center for runaway, theft, truancy and tampering with an automobile, was arrested for that homicide. The next day he was brought before a justice of the peace in Raleigh...
