Appellants Berry Lee Palmer and James Howard were both charged in the first count of a two-count indictment with conspiracy to distribute heroin in violation of 21 U.S.C. § 846; the second count charged Howard alone with engaging in a "continuing criminal enterprise" in violation of 21 U.S.C. § 848.
