Appellant was convicted of first degree felony murder and first degree premeditated murder in 1975 and his conviction was affirmed on direct appeal. May, Lynk v. State, (1976) 265 Ind. 25, 349 N.E.2d 171. Thereafter appellant was granted post-conviction relief by the trial court in the form of a new trial.
