Appellant was charged by indictment with assault with intent to murder. At arraignment, in the presence of his attorney, he entered a plea of not guilty. The jury returned a verdict of guilty of assault and battery and fined appellant $500.00. The trial court adjudged appellant guilty of assault and battery, assessed a fine of $500.00 and as additional punishment sentenced him to a term of six months imprisonment in the County jail.
