HYDE, District Judge:

The defendant Darrell Graff Hafen appeals his conviction by a jury of Theft by Deception, in violation of 76-6-405, U.C.A., 1953. His claims of error are:

(1) that he was denied a speedy trial; and (2) that the trial court erred in failing to give defendant's requested jury instruction referring to specific intent to defraud.
