Defendant below, John R. Rush, was charged with the offense of receiving or buying stolen property of a value of $100 or upwards, under section 28-508, R.R.S.1943. Following a trial by jury he was convicted and sentenced to a term of 2 to 4 years in the Nebraska Penal and Correctional Complex.
