Defendant was charged with possession of heroin, MCL 335.341(4)(a); MSA 18.1070(41)(4)(a). On October 28, 1977, Recorder's Court Judge Donald L. Hobson dismissed the charge after concluding that the search of the defendant was improper. Plaintiff's application for delayed leave to appeal was granted on July 26, 1978, and we reverse.
