The defendants are charged with criminal possession of approximately 14,000 pounds of marihuana (Penal Law, § 221.30) which was found aboard a large sailboat of foreign registry manned by them and was at the time moving in a westerly direction just north of Gardiners Island within the territorial waters of the United States.
