The defendant, Leon Weaver, was found guilty of one count of unlawfully and feloniously possessing heroin. The information read:

That the defendant Leon Edward Weaver, in King County, Washington, on or about April 5, 1977, unlawfully and feloniously did have in his possession a certain controlled substance, and a narcotic drug, to-wit: heroin; Contrary to RCW 69.50.401(c), and against the peace and dignity of the state of Washington...
