Robert B. Pillars appeals from his conviction on charges of assault with intent to kill, threatening to use a deadly or dangerous weapon, aiming a weapon, and resisting arrest. On appeal he raises two issues for our consideration: whether the trial court erred in denying his motion for discharge under Ind.Rules of Procedure, Criminal Rule 4; and whether the trial court erred when it failed to dismiss three counts which were filed two judicial days before...
