This is an appeal from a decision of the District Court for Lancaster County, Nebraska, determining that plaintiff herein was subject to the provisions of the Nebraska Commercial Fertilizer and Soil Conditioner Act, sections 81-2,162.01 et seq., R.R. S.1943, as amended (the Act). For the reasons set out herein we find that the plaintiff is not subject to the provisions of the Nebraska Commercial Fertilizer and Soil Conditioner Act, and reverse...
