Horace E. Vail, appellant, brought this declaratory judgment action for construction of a joint venture agreement. In particular, he requested the court to declare that Henry S. Miller Company, appellee, has no authority under their joint venture agreement to sell the joint venture property without the unanimous consent of all the joint venturers. Summary judgment was granted for appellee on the grounds that the joint venture agreement is not ambiguous...
