This case involves the recovery for damages arising out of a boating accident.

On June 1, 1974, plaintiff, William Rue, and his two sons, Louis and Joe, were boating on the Cane River in Natchitoches Parish, Louisiana. On the same day, Brad Cohen, son of the defendant's insured, Morris Cohen, was also boating on the Cane River in his father's boat accompanied by some friends.
