This third-party civil action arose out of, but was severed from, an action for negligence commenced by Joseph and Viola Belanger against Armand G. Silva, doing business as Maple Hill Nursery, for injuries allegedly sustained when Viola slipped and fell while a business invitee on Silva's premises. Before that action was tried, Silva impleaded his insurance agent, John J. Clarke Insurance, Inc. (defendant), as a third-party defendant...
